Questions that come up after an accident
Under the Road Accident Victims Compensation Law, in most cases fault does not need to be proved in order to receive compensation for bodily injury from a road accident. This is one of the central differences between this type of claim and an ordinary tort claim.
Before signing a waiver it is worth checking what is still open: continued treatment, a disability that has not yet stabilised, loss of earnings and rights before the National Insurance Institute. A signature closes the file even if your condition deteriorates.
As a rule, a claim under the Road Accident Victims Compensation Law, 5735-1975, is time barred seven years after the date of the accident. For minors the count begins only at 18, so the period is longer. Alongside that there are much shorter deadlines that are easy to miss, for example with the National Insurance Institute. Do not rely on an estimate. A short conversation will clarify what applies to you.
