Questions that come up in inheritance matters
Where there is no will, distribution follows the Succession Law rather than what was agreed orally within the family. In that case an application is filed for an inheritance order, which determines who the heirs are and what share each of them receives.
An inheritance order is issued where there is no will, and it declares who the heirs are under the law. A probate order is issued where there is a will, and it gives the will binding effect. Both are filed with the Registrar of Inheritance Affairs.
It is possible to object to probate of a will, for example on the grounds of a defect in its execution, undue influence or lack of capacity. There are deadlines for filing an objection, so it is worth looking into this early rather than after the order has been granted.
