Questions that come up in real estate transactions
As early as possible, and in any event before signing any document, including a memorandum of understanding or a binding offer. A signed document is binding even if it was called a draft.
The developer's lawyer represents the developer. He does not check the contract for you and does not point out the clauses that put you at risk, which is why a buyer is normally separately represented.
With an apartment you can see what you are buying. With land, what determines the value sits in the documents: the planning designation, the building rights, planned expropriation and the identity of the seller. That is why land calls for a structured due diligence review.
